These Referral Program Terms & Conditions (these "Terms") create a legal agreement between Flashquotes, LLC. ("Flashquotes," "We," or "Us") and you, an individual or entity ("You"). THESE TERMS ARE EFFECTIVE AS OF THE DATE YOU FIRST PARTICIPATE IN THE REFERRAL PROGRAM (DEFINED BELOW).
These Terms are part of and incorporated into our Terms of Service. Capitalized terms not defined herein are as defined in our Terms of Service. In the event of a conflict between these Terms and any other agreements between You and Flashquotes, these Terms will prevail with respect to the Referral Program.
You, as a current user of Flashquotes, desire to refer prospective users to our platform (each, a "Referral"), as described in these Terms (the "Referral Program"). Accordingly, You and FlashQuotes agree as follows:
You may participate in the Referral Program if You are a current Flashquotes user in good standing (i.e., Your account is active and not in violation of our Terms of Service).
The Referral Program consists of two tiers: the "Referral Tier" (open to all eligible users) and the "Affiliate Tier" (by invitation only for proven referrers).
How It Works: You will receive a unique referral link or code ("Referral Link") to share with prospective users. You may share this Referral Link with individuals or businesses You personally know.
Reward Conditions: Pro credits will be applied only after the Qualified Referral completes their first paid booking. Credits are non-transferable and have no cash value.
How It Works: Users who achieve five (5) Qualified Referrals or $1000 in referred company booking fees may be invited, at Flashquotes’ sole discretion, to join the Affiliate Tier. If accepted, You will enter into a separate affiliate agreement with Flashquotes.
Reward: Affiliates earn a fifteen percent (15%) commission on the Net Revenue (defined as platform fees paid by the Qualified Referral’s clients, less refunds, chargebacks, or credits) generated by their Qualified Referrals during their first twelve (12) months as a Flashquotes user.
Transition: Upon reaching five (5) Qualified Referrals, You may contact Flashquotes to request Affiliate Tier consideration. Approval and commission terms are subject to a formal agreement.
No Self-Referrals: You may not refer Yourself, Your own business, or any entity You control to earn rewards. Self-referrals will be disqualified, and attempts may result in removal from the Referral Program.
Approved Channels: You may only promote Flashquotes through personal referrals, social media, or other channels approved by FlashQuotes in writing. You may not bid on Flashquotes’ branded search terms, register domains containing our trademarks, or use misleading claims.
Fraud Prevention: Flashquotes reserves the right to reject any Referral or withhold rewards if We suspect fraudulent, abusive, or dishonest activity (e.g., creating fake accounts to generate bookings).
Tracking: Flashquotes will track Qualified Referrals via Your Referral Link and notify You of earned rewards through Your account dashboard or email.
Payout Timing: Pro credits will be applied within thirty (30) days of a Qualified Referral’s first paid booking. Affiliate commissions (if applicable) will follow the terms of the separate affiliate agreement.
Disputes: You may raise questions or disputes about rewards within five (5) business days of notification. Unresolved disputes will be addressed in Flashquotes’ reasonable discretion.
Effect of Termination: If You are removed or the Referral Program ends, You will cease promoting Flashquotes, and any earned but uncredited Referral Tier rewards will be forfeited. Affiliate Tier rewards will follow the terms of the affiliate agreement.
You are an independent contractor, not an employee, agent, or partner of Flashquotes. You have no authority to act for or bind Flashquotes.
These Terms are governed by the laws of the State of Colorado, without regard to conflict of laws principles. Any disputes will be resolved exclusively in the state or federal courts of Denver County, Colorado.
These Terms, together with our Terms of Service, represent the entire agreement between You and Flashquotes regarding the Referral Program.
If any provision is found unenforceable, the remaining provisions will remain in effect.
Changes to these Terms will be effective upon posting to our website.
